CITY OF FLEMINGSBURG Drug-Free Workplace Policy

 1. It is the policy of the City of Flemingsburg that its work place shall remain drug-free in compliance with the Drug-Free Workplace Act of 1988 (PL 100-690, Title V, Subtitle D).

 2. No employee of the city shall engage in unlawful manufacture, distribution, dispensation, possession or use of a controlled substance in any workplace of the City of Flemingsburg.

 3. The city recognizes that the possession of drugs and controlled substances seized in connection with an arrest or other proper law enforcement activities, or maintained by the Flemingsburg Police Department for use in drug-education seminars constitutes lawful possession, and that any such drugs are maintained, recorded, accounted for and/or destroyed in accordance with accepted Police Department policy.

   4. Controlled substances are those described in KRS 218.140, or in regulations of the Kentucky Cabinet for Human Resources.

   5. The city shall maintain a Drug-Free Workplace Program; through the implementation of the procedures as set out herein below:

a.                  Each employee is hereby informed that they shall notify the Mayor within five (5) days of any criminal drug statute conviction for a violation in the workplace. Within 30 days, the city will take action as appropriate.

b.                  A Drug-Free Workplace Certification shall be published and shall be read and signed by each city employee, whether full-time or part-time (a copy of said certification is attached and made a part of this ordinance).

c.                  Any employee violating the terms of this policy statement is subject to immediate dismissal.

d.                  Employees found to be abusing drugs, but not convicted of any drug statute violation, will be subject to appropriate disciplinary action up to and including a requirement to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes, or termination. The city will not pay for this rehabilitation.

e.                  Employees should contact the City Clerk/Treasurer for information about drug abuse prevention information and counseling services available in the area.

   6.         This municipal order shall be in full force and effect from and after its adoption, after meeting publication requirements as required below.

   7. All municipal orders or any parts thereof in conflict with the provisions of this ordinance are expressly repealed to the extent of such conflict.
