There was a regular meeting of the Flemingsburg City Council Monday, August 8, 2016 at 7:00 p.m. in the city annex.  Council members present were Ricky Hurst, Kathy Moore, Scott Manning, Georgianna Sparks, Meredith Story, and Van Alexander.  Mayor Martin L. Voiers presided.

               Councilwoman Sparks led the Pledge of Allegiance.  Minutes of the July meeting were presented.  Councilwoman Moore moved to approve.  Councilman Manning seconded the motion.  Councilman Hurst noted that the minutes stated Police Chief Randy Sergent submitted his letter of resignation.  The minutes should state ‘letter of retirement’.  The minutes were unanimously approved with the noted correction.

               Carol Gast, Carla White, Jessica Pugh, and Marla Duncan addressed council regarding the mosquito problem in their neighborhood.  Mayor Voiers instructed Greg Boling to check the area for possible breeding grounds.  The city will contact the Department of Agriculture for assistance.

               The city received one bid for 250 feet of chain link fence that had been declared surplus.  Bobby Moore submitted a bid of $50.  Councilman Hurst moved to accept the bid.  Councilwoman Sparks seconded the motion.  Motion carried. 

There were no bids for the tanker truck or boat.  Councilman Manning moved to re-advertise these items.  Councilman Story seconded the motion.  Motion carried.

Council discussed the ongoing problem with juveniles and vandalism in the city park and walking trail.  Councilwoman Sparks moved to adopt a dusk to dawn curfew with no one under the age of eighteen permitted in the city park or walking trail during that time unless accompanied by a parent or legal guardian.  Councilwoman Moore seconded the motion.  Motion carried.  This will become effective once it is posted in the park areas.

Council discussed a problem with bicycles on the walking trail.  Mayor Voiers will work with City Attorney Tom MacDonald to find a model ordinance to address this issue.

Continuous yard sales were discussed.  It was recommended that the problem be addressed by enforcing the Occupational Tax Ordinance.

Mayor Voiers reported that the Buzzard permit had arrived.

Council discussed the land between Lakeview and Mills Avenue that is owned by the city.  Danny Stephens expressed an interest in buying enough land behind his house to build a shop.  The mayor will check into any legal issues involved in selling the land.  No action was taken.

The following items were presented as surplus:

  • 2004 Chevrolet 2500 HD 4 wheel drive pickup, Vin# 6840.  Replaced.
  • 8FT Western Pro Plus electric snowplow.  Does not fit trucks.
  • 8FT Swenson salt spreader with 10.5 horse power Briggs and Stratton motor and remote control.  Replaced when new truck purchased.
  • Rigid pipe threader stand and threader.  Item has not been used in years.
  • 2-14FT farm gates.  On land when purchased, not needed.
  • 20+ pieces of ½ inch to 1 inch rebar.  Leftover from WWTP project and not needed.

Recommended method for disposition is the sealed bid process.  Council discussed donating the pickup truck to the Rec. Park with the stipulation that the truck be returned to the City when it is no longer needed.  Councilman Story moved to declare all items as surplus except item #1, the pickup truck, and dispose of all items through the sealed bid process.  Councilman Manning seconded the motion.  Motion carried.  Items will be advertised and bids will be accepted until the close of business on Monday, September 12, 2016.

               The first reading of the real estate property tax rate was presented.  Councilman Story moved to adopt the compensating tax rate of .1320 per $100 of assessed value.  Councilwoman Moore seconded the motion.  Motion carried.

               The first reading of the motor vehicle tax rate was presented.  Councilman Hurst moved to adopt the rate of .1977 per $100 of assessed value.  Councilwoman Sparks seconded the motion.  Motion carried.

               Resolution No. 16-8-1 was presented creating the Bluegrass and Central KY Unified Police Protection System.  Councilwoman Moore moved to adopt.  Councilman Manning seconded the motion.  Motion carried.

               Mayor Voiers opened discussion on the need for natural gas at Industrial Park II.  Constellation Energy Group had made a presentation to the Industrial Authority to provide natural gas to the park and finance the project with an anticipated payback of 5-7 years.  However, they would require the city to purchase natural gas from them.  Mayor Voiers, Utilities Superintendent Joe Dunaway, and City Clerk/Treasurer Joy Roark will be meeting with the group Wednesday, August 10th, to obtain more information.  The City’s current natural gas company, Atmos, may also be able to offer a similar deal.

               Joy Roark, City Clerk/Treasurer, provided written financial reports.

               Greg Boling, Codes Enforcement Officer, provided the Codes report.  There was discussion on amending the ordinance regarding building permit requirements.  Greg Boling will research this and report back to council.

               Dave Gray reported on FCA-TV.

               Police Chief Randy Sergent presented a written report for the Police Department.

               Gordon Pepper, Public Works Superintendent, provided a written report.  The ongoing problem with juveniles and the vandalism at the walking trail was discussed.  Installing cameras was recommended.  Chief Sergent will provide a proposal of costs, where to install, and how many will be needed.

               Utilities Superintendent Joe Dunaway reported that Colby McCloud has received Class 2 Water certification.  J.R. Barton was awarded the bid to replace the roof on the distribution center.  The natural gas line has been extended on Greenway and also on behind the Mexican restaurant making it available to other buildings in that section.

               Progress selling the Hyatt property on the by-pass has been hindered by the city being dry.  Steve Donovan is working on a petition for a ‘moist’ vote.

               There were no committee reports.

               Councilman Hurst reported that the pole for the new siren may be set this week or next.

               Mayor Voiers reported the following:

  • Judge Foxworthy was going to use ADF money to purchase two new county signs.
  • Strand Engineers are beginning the design work on the Streetscape project.
  • B.F. Bailey Painting provided a quote of $7,800 to paint City Hall.

 

Mayor Voiers also reported that he had met with OSHA regarding the violations and fines and they agreed to reduce to the fines to $4900, $1400, and $500 for the three violations.  The fines can be repaid in 20 payments of $340 each.  The City also has the option to appeal.  Councilwoman Sparks moved to pay the fines.  Councilwoman Moore seconded the motion.  Motion carried.

 

There being no further business, Councilman Manning moved to adjourn at 8:40 p.m.
