There was a regular meeting of the Flemingsburg City Council Monday, July 11th, 2016 at 7:00 p.m. in the City Annex.  Council members present were Ricky Hurst, Kathy Moore, Scott Manning, Georgianna Sparks, and Meredith Story.  Van Alexander was absent.  Mayor Martin L. Voiers presided.

               Councilwoman Moore led the Pledge of Allegiance.  Minutes of the June 13th and June 20th meetings were presented.  Councilman Manning moved to approve.  Councilwoman Moore seconded the motion.  Motion carried.

               Crystal Ruark, Fleming Co. Chamber Executive Director, presented updates on activities by the Tourism and the Chamber boards.

               City Clerk/Treasurer Joy Roark presented the second reading of Ordinance No. 07-16-1 annexing the Watson and Purvis properties on Mt. Sterling Ave.  Councilwoman Sparks moved to approve.  Councilman Manning seconded the motion.  A roll call was given with Council voting as follows:  Hurst-yes, Moore-yes, Manning-yes, Sparks-yes, and Story-yes.  Motion carried.

               Cheap’s Chevrolet presented the lone bid on a 2016 Chevy Silverado 1500 with 4WD for $27,500.  Councilman Story moved to accept the bid contingent on the specs being approved.  Councilwoman Moore seconded the motion.  Motion carried.

               The Municipal Road Aid Agreement Resolution was presented.  Councilman Manning moved to adopt.  Councilwoman Sparks seconded the motion.  Motion carried.

               The following items were declared as surplus:  1990 C-70 truck with 1600 gallon tank Vin# 4692, 14’ V-bottom boat with trailer, and 250 feet of chain link fence from the city park.   All items have been replaced with newer ones.  Councilman Story moved to declare as surplus and dispose of through the sealed bid process.  Councilman Hurst seconded the motion.  Motion carried.

               City Clerk/Treasurer Joy Roark reported that the books have been closed for another fiscal year.  Preliminary reports have been sent to the auditors and they expect to begin the annual audit the first of August.  Roark also reported that the city will be getting a new website through a company named Revize, which deals solely with government websites.  The site will offer updated features and should be much more user friendly for both city employees and the public.  Written financial reports were provided in the council packets.

               Codes Enforcement Officer Greg Boling was absent.  A written report was provided.

               Police Chief Randy Sergent provided a written report.  Chief Sergent submitted his letter of resignation effective December 31st.  Mayor Voiers stated that the Chief’s position would be advertised August 1st on a state level including the KY State Police, National IACP, and the KY Chiefs Association.  Mayor Voiers is forming an application screening committee and an interview committee.  Councilmembers Moore, Hurst, Sparks, Story and Manning all volunteered to serve.

               Council discussed the recent vandalism at the park.  Chief Sergent recommended setting a ‘dusk to dawn’ curfew at the parks.  No decision was made.

               Public Works Superintendent Dennis Masters is retiring July 31st.

Utilities Superintendent Joe Dunaway reported that the bid process for auto read meters has been completed and he expects to begin the project the first of August.  It should take approximately three months to complete.

There were no committee reports.

Mayor Voiers reported that he is working on an agreement with the Peoples Bank regarding the parking lot next to the bank. 

The application to deal with the buzzard problem has been completed and is ready to send to the US Fish and Wildlife Services.

Mayor Voiers reported on the closing conference with OSHA.  Three violations were found: the city failed to notify OSHA within 72 hours of the incident; employees did not have personal protective equipment; and the employees failed to bleed the gas off before working on the line.  The city was not aware of the requirement to notify OSHA.  Personal Protective equipment has been ordered.  The operating manual will be updated with the right procedure for bleeding the line.  The city could face steep fines, but is eligible for a ‘small city’ discount.  OSHA will send notification in two to four weeks.  KLC will assist in getting the fines reduced.  The Public Service Commission also investigated the incident.  It could be up to two years before the city receives their report.  The city may be subject to fines based on their findings.

Councilman Story reported the streets in Countryview Heights have been resurfaced and the owners would like for the city to accept them.  Dennis Masters said he had met with the owners prior to resurfacing and instructed them on what to do to meet the city’s specifications.  However, they did not do as he had instructed.  The surface of the streets need to be built up more.  He recommended that the city wait at least two years to see how well the streets hold up.

There being no further business Councilman Manning moved to adjourn at 8:05 p.m.
